These Terms of Service ("Terms" or "Agreement") govern your access to and use of our mobile application, website, and related services (collectively, the "Service").By accessing or using the Service, you agree to be bound by these Terms. Donations and related financial transactions are processed through one or more third‑party payment processors, financial institutions, or service providers (collectively, "Payment Providers") that operate independently from MaaserApp.We make commercially reasonable efforts to facilitate donations in accordance with user instructions. In certain circumstances, including technical, compliance, or operational issues, funds may be redirected, delayed, returned, or donated to similar charitable organizations at our discretion, consistent with applicable law and these Terms.MaaserApp may, depending on the feature or transaction, temporarily hold, custody, facilitate, transmit, or submit funds directly or through one or more Payment Providers. Funds may be processed through systems operated by MaaserApp, Payment Providers, or a combination thereof, and are subject to applicable terms, policies, and procedures. We do not control and are not responsible for the acts or omissions of any Payment Provider.We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.---EligibilityYou must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.---Payment Functionality and Third‑Party ProvidersTo use certain features of the Service, including wallet functionality or donations, you may be required to create or connect an account with one or more Payment Providers. • Collect, use, and share information about you as reasonably necessary to provide the Service;
• Act as a limited agent for the purpose of transmitting instructions to Payment Providers.You acknowledge and agree that:• Payment Providers may require you to agree to their own terms of service and privacy policies;
• Funds may be held, transferred, processed, or submitted by MaaserApp, Payment Providers, financial institution partners, or any combination thereof;
• MaaserApp does not guarantee the availability, accuracy, or performance of any Payment Provider;
• Payment functionality may be modified, replaced, or discontinued at any time.We may add, remove, or change Payment Providers at our sole discretion without notice.---FeesWe may charge enrollment, platform, or transaction‑related fees in connection with certain features of the Service. Fees may vary by user type and are subject to change at any time without notice. You authorize us to collect applicable fees through Payment Providers.Fees charged by MaaserApp are not charitable donations and may not be tax‑deductible. Please consult a tax professional.---Refunds and Unallocated FundsDonations are generally final and non‑refundable once processed. If funds remain unallocated due to account closure, removal of a funding source, inactivity, or other reasons, we may, using commercially reasonable efforts, donate such funds to charities associated with your prior activity or to similar organizations, or otherwise handle such funds in compliance with applicable law.---Accounts and RegistrationYou may be required to provide personal and financial information to use the Service. You agree that all information you provide is accurate and complete and that you will keep it updated. Our use of your information is governed by our Privacy Policy.---Electronic CommunicationsYou consent to receive communications from us electronically, including email, SMS, push notifications, or in‑app messages. Standard messaging rates may apply.---Suspension and TerminationWe may suspend or terminate your account or access to the Service at any time, for any reason, without notice or liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.---Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, MAASERAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO MAASERAPP IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.---IndemnificationYou agree to indemnify and hold harmless MaaserApp and its affiliates from any claims arising out of your use of the Service or violation of these Terms.---Dispute Resolution; Arbitration; Class Action Waiver[UNCHANGED FROM PRIOR VERSION EXCEPT FOR REMOVAL OF PAYMENT‑PROVIDER‑SPECIFIC REFERENCES]---Governing LawThese Terms are governed by the laws of the State of New York, without regard to conflict‑of‑laws principles.---MiscellaneousIf any provision is held unenforceable, the remaining provisions shall remain in effect.
